This Distance Sales Agreement governs consumer purchases made through the GOGOLI online store.
This Agreement is designed to operate as part of an automated contractual system. GOGOLI maintains one master version of this Agreement on the online store. For each order, the version presented to the customer before payment is combined with the relevant product information, selected options, prices, quantities, delivery information, customer information, and other order-specific details.
A durable-medium confirmation of the applicable contractual information will be provided for each order, ordinarily by email. Where successfully generated by the configured system, an order-specific PDF may also be attached or otherwise made available in a format that the customer can retain and reproduce without alteration.
The customer is not required to sign a separately drafted agreement for every product. The master Agreement, the applicable Pre-Contract Information, the relevant product information, the checkout summary, the customer’s selections, and the order-specific confirmation together form the contractual record for the individual order.
Nothing in this Agreement excludes, restricts, or replaces any mandatory consumer right, statutory guarantee, product-safety protection, privacy right, or legal remedy applicable to the customer.
1. DEFINITIONS
For the purposes of this Agreement:
“Agreement” means this Distance Sales Agreement, including the version accepted by the customer and the order-specific information incorporated into it.
“GOGOLI,” “Seller,” “Manufacturer,” “we,” “us,” or “our” means Gönül Köseoğlu, operating under the trading name GOGOLI.
“Customer,” “Buyer,” “you,” or “your” means the natural or legal person placing an order through the GOGOLI online store.
“Consumer” means a natural person acting wholly or mainly for purposes outside that person’s trade, business, craft, or profession.
“Store” means the GOGOLI online store operated through gogolihandmade.com.
“Product” means any item offered by GOGOLI, including a ready-to-ship, made-to-order, bespoke, personalised, limited-edition, one-of-a-kind, handmade, or hand-finished item.
“Ready-to-ship product” means an item that has already been produced and is available for preparation and dispatch.
“Standard made-to-order product” means an item produced after an order is placed according to GOGOLI’s standard design, measurements, options, or specifications and not materially personalised for the individual customer.
“Bespoke product” means an item created or materially altered according to the customer’s individual measurements, instructions, design requests, or other non-standard specifications.
“Personalised product” means an item made, marked, arranged, modified, or finished according to an individual customer’s name, initials, wording, colour combination, dimensions, motif placement, design selection, or another clearly personal specification.
“Product page” means the relevant online listing containing the product description, images, materials, measurements, options, production information, care instructions, warnings, and other product-specific information.
“Order-specific confirmation” means the email, PDF, invoice, order record, or other durable-medium record containing the customer’s individual order information and the contractual version applicable when the order was placed.
“Durable medium” means email, PDF, downloadable document, or another medium that enables the customer to store information addressed personally to them and reproduce it unchanged for an adequate period.
“Business day” means a day other than Saturday, Sunday, or an official public holiday in Türkiye.
“Mandatory law” means a legal rule that cannot validly be excluded, limited, or waived by agreement.
2. SELLER, OPERATOR, AND MANUFACTURER
The GOGOLI online store is operated by:

GOGOLI is the trading name used by Gönül Köseoğlu. GOGOLI is not a separate legal entity from its operator.
Unless the relevant product page expressly states otherwise, Gönül Köseoğlu, trading as GOGOLI, is both the manufacturer and seller of the products offered through the Store.

3. CUSTOMER INFORMATION
The customer’s identity and contact information are those supplied during the cart and checkout process.
Depending on the order, this information may include:

Tax or customs information where lawfully required
Company name where voluntarily supplied
Order notes
Bespoke or personalisation information
The customer is responsible for ensuring that the information supplied is accurate, complete, current, and sufficient for payment, production, customs clearance, and delivery.
The order-specific confirmation will identify the customer and the delivery recipient using the information submitted at checkout.
4. TECHNICAL ECOMMERCE PLATFORM
The Store uses Shopify as its technical ecommerce platform.
Shopify may provide functions including:
Website hosting
Product-display infrastructure
Cart and checkout functions
Customer-account functions
Order management
Payment-support infrastructure
Security and fraud-prevention tools
Email and notification functions
Privacy-preference tools
Technical integrations
Shopify is not the manufacturer or seller of GOGOLI products.
Shopify does not manufacture, own, inspect, pack, dispatch, or fulfil GOGOLI products.
Payment may be processed by independent providers displayed at checkout, including iyzico, banks, card networks, Shopify-supported payment services, or other authorised payment institutions.
Shipping may be performed by PTT, DHL, or another postal, courier, or logistics service selected by GOGOLI, together with customs representatives, destination-country delivery services, and other independent providers where applicable.
The use of a third-party platform or service provider does not, by itself, transfer GOGOLI’s legal responsibilities as manufacturer or seller to that provider.

The contractual version applicable to an order is the version presented to the customer before that order was submitted.
A later amendment to a webpage or policy does not retrospectively alter an already accepted order unless:
The customer expressly agrees;
The change benefits the customer without reducing any right;
The change is required by mandatory law;
The change is necessary to address a product-safety issue; or
Mandatory law otherwise permits the change.

7. SUBJECT OF THE AGREEMENT
Under this Agreement, GOGOLI agrees to supply and the customer agrees to purchase the products identified in the order-specific confirmation, subject to:

The applicable production and delivery arrangements
The contractual documents
Mandatory law
Each order is a separate transaction unless the order confirmation expressly states otherwise.
Unless expressly described as a subscription, recurring service, or continuing arrangement, a purchase from GOGOLI is a one-time transaction.
8. PRE-CONTRACT INFORMATION
Before submitting the order, the customer is provided with or given access to information concerning, as applicable:

Currency
Taxes
Shipping charges
Potential customs and import charges

The customer is required to confirm that they have had the opportunity to review the applicable information before proceeding to payment.
The Pre-Contract Information forms an integral part of this Agreement.
9. PRINCIPAL CHARACTERISTICS OF THE PRODUCTS
The principal characteristics of each product are stated on the relevant product page and incorporated into the order.

10. HANDMADE CHARACTER
GOGOLI products are individually handmade or hand-finished.
The customer acknowledges that reasonable differences may occur between products or between a product and its photographic representation.
Reasonable handmade variation may include variation in:
Stitch tension
Motif position
Motif alignment
Dimensions
Shape
Surface character
Texture
Weight
Yarn thickness
Material structure
Colour distribution
Decorative component placement
Finishing details
Handmade joins
Transitions between rows or motifs
Natural leather markings
Paper-yarn texture
Metal-component finish
Minor differences of this kind are part of the handmade character of the product and do not, by themselves, constitute a defect.
This provision does not apply where the product:
Materially differs from its description;
Materially differs from approved bespoke specifications;
Is incorrectly made;
Is damaged;
Is unsafe;
Is legally defective; or
Otherwise fails to comply with mandatory law.
11. COLOUR, IMAGES, AND DISPLAY DIFFERENCES
GOGOLI takes reasonable care to present products accurately.
However, product colour and appearance may vary because of:

Display calibration
Device type
Lighting
Photography
Editing necessary for accurate presentation
Ambient conditions
Material texture
Dye lots
Yarn batches
Leather batches
Metal finishes
Paper-yarn batches
A minor screen-to-product colour difference does not, by itself, constitute a defect where the supplied product corresponds substantially to the described colour and selected material.
Where an exact shade is essential, the customer should contact GOGOLI before ordering.
A digital image, colour name, or sample cannot guarantee complete identity between different material or production batches unless GOGOLI expressly confirms this in writing.
12. PRODUCT IMAGES, MODELS, AND PROPS
Product images and videos form part of the product presentation but must be read together with the written description.
Objects appearing in photographs are not included unless expressly identified as part of the purchase.
Non-included items may include:

Jewellery
Furniture
Flowers
Decorative objects
Packaging props
Display stands
Mannequins
Baskets
Books
Tableware
Background textiles
Other products appearing for scale or styling
Where a product is shown on a model, appearance and fit may vary according to:
Height
Body proportions
Shoulder shape
Bust
Waist
Hip
Posture
Preferred ease
Layering
Personal styling
Model information is contextual and does not replace the stated product measurements.
13. MEASUREMENTS, SIZE, AND FIT
The customer must review all measurements and size information before purchasing a garment or wearable product.
Unless expressly stated otherwise, measurements refer to the product itself rather than body measurements.
The customer should compare the stated product measurements with:
Their own body measurements;
A similar item that fits them comfortably; and
Their preferred fit and ease.
Handmade products may have a reasonable measurement tolerance arising from:
Material elasticity
Stitch tension
Construction method
Blocking
Finishing
Storage
Temperature
Humidity
Natural settling of the material
Any specific tolerance stated on the product page applies to the product concerned.
The customer is responsible for selecting the size or measurements offered on the product page.
This does not limit the customer’s rights where:
The incorrect size was supplied;
The product materially differs from its stated measurements;
The product materially differs from approved bespoke measurements; or
The product is otherwise non-conforming.
14. MATERIALS, FIBRE COMPOSITION, AND SENSITIVITIES
The materials and fibre composition known to GOGOLI will be disclosed on the relevant product page.
Products may contain, depending on the individual item:
Cotton
Wool
Acrylic
Polyester
Paper yarn
Leather
Synthetic leather where expressly stated
Metal components
Chains
Buttons
Fasteners
Adhesives
Linings
Dyes
Decorative components
Packaging materials
Finishing materials
The exact composition may vary between product versions.
Where different colour or yarn versions use different fibre compositions, this will be stated in the relevant product information.
A customer with a known allergy, skin sensitivity, metal sensitivity, wool sensitivity, dye sensitivity, fragrance sensitivity, or material restriction must review the disclosed composition and contact GOGOLI before ordering where further information is reasonably required.
GOGOLI does not provide medical advice and does not guarantee that a material will be suitable for every individual sensitivity unless expressly confirmed in writing.
This provision does not remove any mandatory product-safety obligation.
15. CARE, USE, AND STORAGE
The customer must follow all care, use, storage, and safety instructions supplied with or displayed for the product.
Depending on the product, instructions may include requirements concerning:

Water temperature
Detergent
Bleach
Dry cleaning
Machine washing
Machine drying
Flat drying
Reshaping
Ironing
Steam
Storage
Folding
Hanging
Moisture
Direct sunlight
Heat
Contact with cosmetics
Contact with perfume
Contact with water
Contact with sharp objects
Excessive loading
Pulling
Stretching
Children and pets
Damage caused by use contrary to clearly supplied instructions may not constitute a manufacturing defect.
Normal ageing, reasonable wear, fibre movement, pilling consistent with the material, tarnishing consistent with the metal, softening, or gradual changes caused by use are not defects unless the product fails to meet a mandatory standard or an express contractual promise.
16. PRODUCT STATUS AND AVAILABILITY
A product may be described as:

Temporarily unavailable
Adding a product to the cart does not reserve it unless the Store expressly states otherwise.
GOGOLI may review availability, materials, delivery restrictions, and the feasibility of the requested specifications before accepting an order.
GOGOLI will not arbitrarily cancel an accepted consumer order.
Ordinary stock shortage alone will not be treated as legal impossibility where mandatory law provides otherwise.
Where performance becomes genuinely impossible, GOGOLI will provide the notice, refund, and other remedy required by applicable law.
17. STANDARD MADE-TO-ORDER PRODUCTS
A standard made-to-order product is produced after the order is placed using GOGOLI’s standard design and available options.
A product is not automatically bespoke or non-returnable merely because production begins after the order is placed.
Unless a lawful exception applies, a standard made-to-order product that has not been created to the customer’s individual specifications remains subject to any mandatory withdrawal right applicable to the customer.
The production estimate shown on the product page or confirmed in writing forms part of the order.
18. BESPOKE AND PERSONALISED PRODUCTS
A product may be bespoke or personalised where it is created or materially altered according to the customer’s individual request.
Individual specifications may include:

Non-standard length
Non-standard width
Individual fit
Selected motif arrangement
Selected motif placement
Customer-selected colour combination

Before dedicated production or material preparation begins, GOGOLI may require written confirmation of:

The customer must review all bespoke specifications carefully.
The customer is responsible for the accuracy of measurements, spelling, wording, and other information supplied by the customer.
Where GOGOLI identifies an apparent inconsistency, GOGOLI may request clarification before production.
GOGOLI is not responsible for delay caused by the customer’s failure to provide or approve necessary information.
Where an aspect has not been specified by the customer, GOGOLI may use reasonable professional and artistic judgment consistent with:
The agreed design;
The product description;
The selected materials; and
GOGOLI’s established visual language.
Once the customer has approved the specifications and dedicated production or material preparation has begun, changes may be refused or may require:
Additional payment;
Additional production time;
A revised delivery estimate; or
A new written agreement.
Products made to the customer’s individual specifications or clearly personalised may be excluded from change-of-mind withdrawal rights where permitted by applicable law.
This exclusion does not affect rights concerning a product that is:
Damaged;
Defective;
Unsafe;
Incorrect;
Materially different from the approved specifications; or
Otherwise non-conforming under mandatory law.
19. PRICE AND CURRENCY
The price of each product is displayed on the product page and confirmed in the final checkout summary.
The amount payable for an individual order is the final total displayed before the order is submitted.
The total may include:

Personalisation charge
Bespoke-design charge
Discount
Shipping charge
Tax collected at checkout

Other expressly agreed charge
Prices are displayed and processed in the currency shown at checkout.
The customer’s bank, card issuer, or payment provider may independently apply:

Exchange-rate adjustment
Foreign-transaction fees
Bank fees
Card fees
Such independently imposed charges are not retained or controlled by GOGOLI.
20. TAXES, CUSTOMS DUTIES, AND IMPORT CHARGES
Tax treatment may depend on:
The delivery destination
The customer’s location
The product type
Applicable law
The checkout configuration
The selected shipping service
Where tax or duty is collected at checkout, the amount will appear in the final order summary.
Unless the checkout or order confirmation expressly states that duties and import taxes have been prepaid, international orders are generally shipped on a Delivered at Place — DAP basis.
Under a DAP arrangement, the recipient may be responsible for charges imposed after dispatch, including:
Import VAT
Customs duty
Import tax
Brokerage
Disbursement fees
Customs-processing fees
Carrier-administration fees
Storage charges
Inspection charges
Destination-country charges
These amounts may be imposed by an independent authority, carrier, bank, or service provider.
GOGOLI does not control or retain amounts paid directly to those third parties.
The customer is responsible for checking the import rules applicable to the destination country.
21. CUSTOMS DECLARATIONS
GOGOLI will complete customs information truthfully.
GOGOLI will not:
Declare a false value;
Describe a commercial sale as a gift;
Use an inaccurate product description;
Provide false origin information;
Split an order to evade lawful charges;
Participate in an unlawful customs arrangement.
The customer must not request GOGOLI to provide inaccurate customs information.
A refusal to make a false declaration does not give the customer a right to cancel an otherwise valid bespoke or personalised order beyond any right provided by law.
22. PAYMENT
Available payment methods are displayed at checkout.
The customer must use a valid and authorised payment method.
Payment may be subject to:

Bank approval
Payment-provider rules
Sanctions controls
Regulatory controls
GOGOLI does not ordinarily receive or store the customer’s full card number, security code, or online-banking password.
Payment authorisation may be temporary until the payment provider completes processing.
Where payment fails, is reversed, is rejected, or is reasonably identified as unauthorised, GOGOLI may suspend acceptance, production, or dispatch.
23. PAYMENT OBLIGATION
Submitting the final order creates an obligation to pay the total amount displayed at checkout.
The final order button or equivalent checkout function must clearly communicate that the order entails payment.
The customer may be required to confirm that they have read and accept:

Any acceptance checkbox must not be pre-selected.
Privacy information does not become marketing consent merely because the Privacy & Data Protection Policy is made available during checkout.
Marketing consent is separate and optional.
24. ORDER REVIEW AND CORRECTION
Before submitting an order, the customer is given an opportunity to review and, where technically available, correct:

Where an error is discovered after submission, the customer should contact GOGOLI promptly.
A requested correction cannot be guaranteed after:

Dedicated materials have been prepared;
Personalisation has begun;
Fulfilment preparation has begun; or
The parcel has been dispatched.
Where a correction is possible, it may change:

25. ORDER SUBMISSION AND CONTRACT FORMATION
Product pages and Store content invite customers to submit an order and do not necessarily constitute an irrevocable offer.
By submitting the order, the customer offers to purchase the selected products under the information and conditions presented before payment.
An automated order-receipt message confirms that the order has been received.
Unless the message expressly states otherwise, an automated receipt does not necessarily mean that GOGOLI has finally accepted the order.
Subject to mandatory law, an order is accepted when GOGOLI first:
Sends an express acceptance or fulfilment confirmation;
Dispatches a ready-to-ship product; or
Confirms the required specifications and begins dedicated production or preparation for a made-to-order, bespoke, or personalised product.
Where applicable law treats the contract as concluded at an earlier point, that mandatory rule applies.
Before acceptance, GOGOLI may review:
Payment status
Product availability
Material availability
The feasibility of requested specifications
Delivery restrictions
Address information
Customs restrictions
Sanctions restrictions
Fraud indicators
Obvious pricing or technical errors
Product-safety requirements
GOGOLI may decline an order before acceptance for a legitimate and legally permitted reason.
Where payment has been collected for an order that is not accepted, the applicable amount will be refunded.
26. OBVIOUS ERRORS
GOGOLI takes reasonable care to keep product, price, availability, currency, tax, shipping, and checkout information accurate.
An obvious and objectively recognisable error may include:
A misplaced decimal point
A clearly impossible price
A duplicated discount
A currency-display malfunction
A technical calculation failure
A clearly incorrect product image
An inventory-system error
A publication error
Where an obvious error is discovered before acceptance, GOGOLI may:
Correct the information;
Ask the customer to confirm the order under the corrected information; or
Decline the order and refund any payment collected.
Where an error is discovered after acceptance, GOGOLI will not unilaterally reduce the customer’s mandatory rights.
Any correction or cancellation after acceptance will be handled only where permitted by mandatory law.
27. PRODUCTION AND PROCESSING
Processing time is separate from carrier delivery time.
Ready-to-ship products are normally prepared for dispatch within 2–3 business days after payment has been confirmed.
Made-to-order products are produced according to the estimate stated on the product page.
Bespoke and personalised products are produced according to the estimate displayed or confirmed in writing.
Production may begin after:
Payment has been confirmed; and
All necessary measurements, colours, materials, wording, design details, and approvals have been received.
Production estimates may be affected by:
Complexity
Handmade construction
Material availability
Customer approval delays
Customer-requested changes
Seasonal volume
Serious illness
Emergency
Power or internet interruption
Platform interruption
Carrier interruption
Government action
Customs action
Events outside reasonable control
Where a material delay occurs, GOGOLI will provide the information and options required by applicable law.
28. DELIVERY PERIOD
Unless a different period is expressly agreed, GOGOLI will deliver consumer goods within the maximum period required by applicable law.
Where Türkiye consumer law applies, goods will ordinarily be delivered within the promised period and no later than the applicable statutory maximum, unless a longer period has been expressly agreed for a product prepared according to the customer’s request or personal needs.
Where European Union, European Economic Area, or United Kingdom consumer law applies, delivery will ordinarily take place within 30 days after the contract is concluded unless another delivery period has been expressly agreed.
A product-page production estimate and the delivery estimate displayed before payment may together constitute an expressly agreed longer performance period for a made-to-order, bespoke, or personalised product.
A guaranteed delivery date applies only where GOGOLI expressly confirms in writing that the date is guaranteed.
29. SHIPPING METHODS
Shipping methods available for the destination are displayed at checkout.
GOGOLI may use PTT, DHL, or another postal, courier, or logistics service selected by GOGOLI, together with destination-country delivery partners where applicable.
The selected provider may depend on:

Operational restrictions
International shipments will ordinarily use a tracked service.
Tracking availability and detail may vary between countries and carriers.
30. DELIVERY ESTIMATES
Carrier delivery estimates begin after dispatch.
They do not include production or processing time unless expressly stated otherwise.
Delivery estimates are not guarantees unless an expressly guaranteed service has been purchased and confirmed.
Delivery may be affected by:
Customs procedures
Security screening
Weather
Transport disruption
Public holidays
Peak periods
Strikes
Remote-area delivery
Incorrect address information
Failure to respond to the carrier
Failure to pay import charges
Government action
Events outside GOGOLI’s reasonable control
GOGOLI remains responsible for obligations that mandatory law places on the seller despite the involvement of an independent carrier.
31. TRANSFER OF RISK
For consumer orders, the risk of loss or transport damage remains with GOGOLI until the product is delivered to:
The customer; or
A third person designated by the customer who is not the carrier.
Where the customer independently instructs a carrier not offered by GOGOLI, risk may transfer when the product is handed to that carrier to the extent permitted by applicable law.
The carrier’s possession of a parcel does not, by itself, constitute delivery to the customer.
After lawful delivery, the customer is responsible for reasonable safekeeping of the parcel and product.
32. CUSTOMER DELIVERY OBLIGATIONS
The customer must provide accurate and complete delivery information.
This may include:
Recipient name
Street address
Building number
Apartment or unit
Floor
District
City
Postal code
Country
Telephone number
Email address
Customs identification where lawfully required
The customer must monitor tracking and respond to reasonable requests from:
GOGOLI
The carrier
The postal operator
Customs
A customs broker
A delivery partner
Address changes requested after checkout cannot be guaranteed.
An address change after dispatch may not be possible.
Costs directly caused by inaccurate or incomplete customer-supplied information may be charged or deducted from an otherwise payable refund only to the extent permitted by law.
33. CUSTOMS DELAY AND CUSTOMER NON-COOPERATION
The customer is responsible for completing lawful destination-country customs requirements.
Failure to:
Supply required information;
Respond to customs;
Pay lawful import charges;
Collect the parcel;
Arrange redelivery; or
Complete clearance
may result in:
Delay
Return to sender
Storage
Abandonment
Confiscation
Destruction
Disposal
A refusal to pay a lawfully disclosed import charge does not automatically constitute a valid statutory withdrawal.
Where a parcel is returned, abandoned, destroyed, or otherwise not delivered because of customer non-cooperation, the refund consequences will be assessed under:
Mandatory law;
The Shipping Policy;
The Returns, Refunds & Cancellations Policy;
The actual recoverable value of the product; and
The reasonable, documented costs incurred.
No deduction will be made where prohibited by mandatory law.
A bespoke or personalised product does not become eligible for a change-of-mind refund merely because the customer refuses delivery or customs clearance.
34. UNCLAIMED OR REFUSED PARCELS
A parcel that is:
Refused;
Unclaimed;
Not collected;
Returned because of an incorrect address;
Returned because of failed delivery attempts; or
Returned because required import procedures were not completed
will not automatically be treated as a valid cancellation or withdrawal notice.
The customer must separately communicate any withdrawal decision in a clear manner where required by law.
Where the product is eligible for return, GOGOLI will process the matter after the product has been returned or sufficient evidence is available, subject to the applicable legal rules.
Where legally permitted, GOGOLI may deduct documented and unrecoverable costs caused by the customer’s acts or omissions.
35. RIGHT OF WITHDRAWAL — EUROPEAN UNION, EUROPEAN ECONOMIC AREA, AND UNITED KINGDOM
Unless a lawful exception applies, a consumer in the European Union, European Economic Area, or United Kingdom may withdraw from an eligible distance sales contract within 14 calendar days without giving a reason.
For a contract concerning one product, the period generally begins when the consumer or a person designated by the consumer, other than the carrier, takes physical possession of the product.
For multiple products ordered together and delivered separately, the period generally begins when the last product is received.
For a product delivered in multiple parts, the period generally begins when the last part is received.
The consumer may communicate withdrawal by:
Email;
The model withdrawal form; or
Another clear statement expressing the decision to withdraw.
The model form is optional.
The notice may be sent to:
The withdrawal is exercised within the deadline where the notice is sent before the 14-day period expires.
36. EU, EEA, AND UK RETURN PERIOD
After communicating withdrawal, the consumer must return the eligible product without undue delay and ordinarily no later than 14 days after sending the withdrawal notice.
The deadline is met where the product is dispatched before the 14-day return period expires.
The consumer should contact GOGOLI before sending the return so that the correct return address and instructions can be provided.
Failure to contact GOGOLI before dispatch does not invalidate an otherwise valid statutory withdrawal, but may delay identification or processing.
The customer must use a tracked return method and retain proof of dispatch.
37. EU, EEA, AND UK RETURN COSTS
For an eligible change-of-mind withdrawal, the customer bears the direct cost of returning the product where this responsibility was disclosed before purchase.
GOGOLI will bear or reimburse reasonable return costs where:
GOGOLI expressly agrees;
The product is damaged;
The product is defective;
The product is unsafe;
The incorrect product was supplied;
The product is materially misdescribed; or
Mandatory law requires GOGOLI to bear the cost.
Where the customer selects a return service that is unnecessarily expensive, GOGOLI is responsible only for the reasonable amount required by mandatory law.
38. EU, EEA, AND UK WITHDRAWAL REFUNDS
For a valid withdrawal, GOGOLI will reimburse the payments required by applicable law without undue delay and ordinarily no later than 14 days after receiving the withdrawal notice.
The reimbursement will include the cost of the least expensive standard delivery method offered for the original order where required by law.
Additional amounts paid because the customer selected express, premium, or upgraded delivery are not refundable beyond the standard-delivery amount unless mandatory law requires otherwise.
Unless GOGOLI offers to collect the product, GOGOLI may withhold reimbursement until:
The returned product is received; or
The customer supplies acceptable evidence of dispatch,
whichever occurs first.
The refund will be issued using the original payment method unless another method is expressly agreed and the customer incurs no fee as a result.
39. RIGHT OF WITHDRAWAL — TÜRKİYE
Unless a lawful exception applies, a consumer in Türkiye may withdraw from an eligible distance sales contract within 14 days without giving a reason and without paying a contractual penalty.
For goods, the period generally begins when the consumer or a third person designated by the consumer receives the product.
The consumer may also exercise the applicable withdrawal right between the formation of the contract and delivery.
For multiple products delivered separately, the relevant period begins when the final product is received.
For a product consisting of multiple parts, the relevant period begins when the final part is received.
Withdrawal may be communicated in writing or through a durable medium, including email.
The withdrawal notice may be sent to:
The consumer may use the model withdrawal form but is not required to do so.
40. TÜRKİYE RETURN PERIOD
Unless GOGOLI offers to collect the product, a consumer in Türkiye must return the eligible product within 14 days after communicating the withdrawal decision.
The consumer should request the applicable return instructions and designated carrier information before dispatch.
Failure to request instructions does not invalidate an otherwise valid statutory withdrawal but may affect the applicable return process.
41. TÜRKİYE RETURN SHIPPING
Where the product is returned using a carrier designated or otherwise confirmed by GOGOLI in accordance with the Pre-Contract Information, the consumer will not be charged the return shipping cost.
Where no designated return carrier was disclosed, the consumer will not be charged a return shipping cost.
Where the designated carrier has no branch in the consumer’s location, GOGOLI will arrange collection without imposing an additional charge, as required by applicable law.
A consumer who voluntarily uses a different carrier without prior agreement should contact GOGOLI first.
The effect of using a different carrier on the refund timetable will be determined according to applicable law.
A consumer will not be charged return costs for a damaged, defective, unsafe, incorrect, or legally non-conforming product.
42. TÜRKİYE WITHDRAWAL REFUNDS
For an eligible withdrawal after delivery, GOGOLI will refund the payments required by applicable law within 14 days beginning from the applicable legal trigger.
Where the product is handed to the return carrier specified in the Pre-Contract Information, the refund period begins from the date the product is handed to that carrier, to the extent required by applicable law.
Where the customer uses another carrier, the refund period may begin when the returned product reaches GOGOLI, to the extent permitted by applicable law.
Where withdrawal occurs before delivery, GOGOLI will refund the applicable payments within 14 days after receiving the withdrawal notice.
The refund will include the original delivery cost where required by law.
Refunds will be made in one transaction using a method compatible with the original payment instrument and without imposing a cost or additional obligation on the consumer.
43. DESTINATIONS OUTSIDE THE EU, EEA, UK, AND TÜRKİYE
For destinations outside the European Union, European Economic Area, United Kingdom, and Türkiye, GOGOLI does not provide a voluntary change-of-mind return right unless:
The product page expressly provides one;
GOGOLI agrees in writing; or
Mandatory local law provides one.
This provision does not limit mandatory rights relating to products that are:
Damaged;
Defective;
Unsafe;
Incorrect;
Materially different from their description; or
Otherwise legally non-conforming.
Where a voluntary return is accepted, the deadline, address, shipping responsibility, and permitted deductions will be confirmed in writing.
44. WITHDRAWAL EXCEPTIONS
Subject to mandatory law, the right to withdraw because of a change of mind may not apply to:
Products made to the customer’s individual specifications;
Clearly personalised products;
Products materially altered according to customer-approved specifications;
Sealed goods that are unsuitable for return for genuine health-protection or hygiene reasons and have been unsealed after delivery, where the legal exception applies and was disclosed before purchase;
Other products lawfully excluded from withdrawal.
A product is not excluded merely because it is handmade.
A product is not excluded merely because it is produced after the order is placed.
A standard made-to-order product remains subject to mandatory withdrawal rights unless it is genuinely made to individual specifications or another lawful exception applies.
The withdrawal exception does not remove rights concerning damage, defect, safety, incorrect supply, misdescription, or non-conformity.
45. HYGIENE-SENSITIVE PRODUCTS
Where a product is supplied in a sealed package and is unsuitable for return after opening for genuine hygiene or health-protection reasons, the applicable product page or packaging will identify this before purchase.
This may apply to certain earrings or body-contact accessories only where:
The product is lawfully covered by the exception;
The product is supplied sealed;
The seal has been broken after delivery; and
The exception was clearly disclosed before purchase.
GOGOLI will not rely on a hygiene exception merely because a product has been tried on where the legal conditions for the exception are not satisfied.
46. HANDLING AND DIMINISHED VALUE
ACTUAL USE AND VOLUNTARY RETURNS
A product showing evidence of actual use beyond reasonable inspection will not be accepted as a voluntary change-of-mind return.
Evidence of actual use may include:
Wearing the product outside or for an extended period
Using a bag to carry personal belongings
Washing, cleaning, ironing, steaming, or dry-cleaning
Stains, makeup, bodily residue, food, liquid, or dirt
Perfume, cosmetic, smoke, cooking, or other persistent odours
Pet hair
Stretching, reshaping, pulling, or distortion
Cutting, repairing, altering, or customising
Damage to yarn, stitches, lining, closures, straps, chains, labels, or decorative components
Missing accessories or components
Any condition preventing the product from being safely and lawfully resold as new
Where no mandatory statutory withdrawal right applies, GOGOLI may refuse the return of a product showing evidence of actual use.
Where a mandatory statutory withdrawal right applies, actual use beyond what is reasonably necessary to establish the product’s nature, characteristics, fit, appearance, or functioning may result in a deduction for diminished value to the fullest extent permitted by applicable law.
The amount of any deduction will be based on the condition of the returned product, available evidence, cleaning or restoration possibilities, and the reduction in the product’s resale value.
Nothing in this section limits rights relating to a product that is damaged, defective, unsafe, incorrect, materially misdescribed, or otherwise legally non-conforming.
Where withdrawal rights apply, the customer may inspect the product only to the extent reasonably necessary to establish its:
Nature
Characteristics
Fit
Appearance
Functioning
Where permitted by law, the customer may be responsible for diminished value caused by handling beyond what would normally be permitted in a physical shop.
Excessive handling may include:
Extended wearing
Washing
Staining
Stretching
Cutting
Repairing
Reshaping
Removing fixed parts
Adding perfume
Exposing the product to smoke
Exposing the product to pet hair
Using the product outdoors beyond reasonable inspection
Using a bag to carry items
Using a textile as household furnishing
Altering a garment
Damaging labels or components
Returning incomplete contents
Excessive handling does not automatically extinguish a statutory withdrawal right where the applicable law instead provides for a deduction reflecting diminished value.
Any deduction will be reasonable, evidence-based, and limited to the amount permitted by law.
47. RETURN CONDITION
Where a product is returned, it should, to the extent permitted by applicable mandatory law, be:
Unwashed
Unaltered
Not used beyond what is reasonably necessary for inspection
Free from stains
Free from fragrance
Free from smoke
Free from makeup
Free from pet hair
Free from avoidable damage
Returned with all included accessories and components
Returned with labels and protective materials where reasonably possible
Securely packaged to prevent damage during return transit
Original packaging should be returned where reasonably available.
The absence of original packaging alone does not automatically invalidate an otherwise eligible statutory withdrawal.
Where permitted by applicable law, a proven reduction in value caused by missing components, damaged packaging, removed labels, avoidable damage, or handling beyond what is reasonably necessary to inspect the product may be taken into account when calculating the refund.
Nothing in this section limits the customer’s rights where a product is damaged, defective, unsafe, incorrect, materially misdescribed, materially different from approved bespoke specifications, or otherwise legally non-conforming.
48. RETURN AUTHORISATION AND ADDRESS
Customers should not send a return to an address found independently online without first confirming the correct return address.
The return address may differ from:
The business-contact address;
The manufacturing address;
The EU responsible person’s address;
A carrier office;
An address shown on an older document.
The EU authorised representative is not authorised to receive customer returns unless GOGOLI expressly confirms otherwise in writing.
A return sent to the wrong address may be delayed, rejected, lost, or incur additional cost.
A valid statutory right will not be denied solely because the customer did not request discretionary permission, but the customer remains responsible for following reasonable and legally valid return instructions.
49. INTERNATIONAL RETURN CUSTOMS
A customer returning a product internationally must complete return customs documents truthfully.
The parcel should be accurately described as returned merchandise where appropriate.
The customer must not:
Describe the return as a new commercial sale;
Declare an intentionally false value;
Describe it as a gift where inaccurate;
Omit information required by customs.
Before dispatch, the customer should request GOGOLI’s return instructions.
Packages sent:
Cash on delivery;
With unpaid import charges;
With incorrect customs declarations; or
Without sufficient identification
may be delayed or refused where legally permitted.
Refusal of an improperly dispatched parcel does not remove a mandatory statutory right but may delay processing and may make the customer responsible for avoidable costs to the extent permitted by law.
50. DAMAGED, DEFECTIVE, UNSAFE, OR INCORRECT PRODUCTS
The customer should inspect the order promptly after delivery.
The customer should contact GOGOLI where a product:
Arrives damaged;
Is defective;
Is unsafe;
Is incorrect;
Is incomplete;
Materially differs from its description;
Materially differs from approved bespoke specifications; or
Has been damaged in transit.
Contact:
The customer should provide where reasonably available:
Order number
Product name
Product identifier or SKU
Description of the issue
Photographs
Video
Photographs of the outer package
Photographs of the inner packaging
Photograph of the shipping label
Details of any injury or accident
Notification within 48 hours of visible transport damage assists with evidence preservation and carrier claims.
Failure to notify GOGOLI within 48 hours does not remove a mandatory statutory right.
51. PRESERVING EVIDENCE
The customer should not discard, wash, repair, alter, dismantle, or continue using a product involved in a defect or safety complaint before GOGOLI has had a reasonable opportunity to review the issue.
This does not apply where immediate action is reasonably necessary to prevent injury or further damage.
GOGOLI may reasonably request:
Additional photographs;
A video;
Measurements;
The batch or SKU information;
A description of use;
The care method used;
Return of the product for inspection.
Evidence requests will be proportionate and will not be used to obstruct a genuine statutory claim.
52. REMEDIES FOR NON-CONFORMING PRODUCTS
Where a product is confirmed or legally deemed to be damaged, defective, unsafe, incorrect, misdescribed, or non-conforming, the available remedy may include:
Repair;
Replacement;
Re-performance;
Price reduction;
Partial refund;
Full refund;
Contract termination;
Another remedy required by applicable law.
The appropriate remedy may depend on:
The applicable law;
The nature of the issue;
Whether repair is possible;
Whether equivalent materials remain available;
Whether replacement is proportionate;
Whether the product is one of a kind;
The customer’s mandatory rights.
GOGOLI will bear reasonable return costs where required by law.
A customer is not required to accept a discretionary repair or replacement where mandatory law gives the customer another remedy.

53. LEGAL GUARANTEES
Consumers retain all mandatory legal guarantees concerning:
Conformity
Quality
Description
Durability where legally applicable
Safety
Fitness for disclosed purpose
Installation where applicable
Digital elements where applicable
Other statutory standards
A legal guarantee is separate from a change-of-mind withdrawal right.
The duration and content of the legal guarantee depend on the law applicable to the order.
Nothing in this Agreement replaces or reduces a statutory legal guarantee.
54. COMMERCIAL WARRANTY
Unless a product page or accompanying document expressly states otherwise, GOGOLI does not provide an additional voluntary commercial warranty beyond:
The product description;
Any expressly stated written promise; and
Mandatory statutory rights.
General statements about craftsmanship, care, expected use, or quality must be read together with:
The disclosed materials;
The intended use;
The care instructions;
The storage instructions;
Normal wear and ageing.
55. ORDER CANCELLATION BEFORE DISPATCH
A customer wishing to cancel an order should contact GOGOLI as soon as possible.
For a ready-to-ship product, GOGOLI will make reasonable efforts to stop preparation or dispatch.
Cancellation cannot be guaranteed after the parcel has been handed to the carrier.
Where dispatch can no longer be stopped, any applicable statutory withdrawal right remains unaffected.
For a standard made-to-order product, cancellation will be assessed according to:
The production stage;
The applicable withdrawal right; and
Mandatory law.
For a bespoke or personalised product, cancellation may no longer be possible after:
The customer has approved the specifications; and
Dedicated production or material preparation has begun,
where permitted by applicable law.
A valid statutory withdrawal does not depend on GOGOLI’s discretionary approval.
56. CUSTOMER-REQUESTED CHANGES
A customer-requested change after order submission may be accepted or rejected depending on:
Production stage
Material availability
Technical feasibility
Design integrity
Safety
Shipping preparation
An accepted change may require:
An additional charge;
A partial refund;
Additional production time;
A revised delivery estimate;
A written confirmation.
No additional charge will be imposed without the customer’s agreement.
57. REFUNDS
Approved refunds will ordinarily be issued to the original payment method.
Where another refund method is used, it must be expressly agreed and legally permitted.
The time required for the refund to appear may depend on:
The bank;
The card issuer;
The payment provider;
The currency;
The payment network.
GOGOLI is responsible for issuing the refund within the legally applicable period but does not control a bank’s internal posting time.
GOGOLI is not responsible for differences caused independently by:
Exchange-rate changes;
Bank fees;
Card-issuer fees;
Payment-provider conversion fees.
This does not permit GOGOLI to retain any amount that must legally be refunded.
58. GIFT CARDS, DISCOUNTS, AND PROMOTIONS
Gift cards, discount codes, and promotions are subject to the terms displayed when issued or used.
Unless mandatory law requires otherwise:
Discounts have no separate cash value;
A discount cannot be retrospectively added after an order is submitted;
Only eligible discounts may be combined;
A refund will not exceed the amount actually paid for the returned product.
Where an entire order discount is allocated across multiple products, the refund may reflect the proportionate discounted amount paid for the returned item.
A promotion does not reduce statutory consumer rights.
59. CHARGEBACKS AND PAYMENT DISPUTES
A customer retains the right to use a lawful payment-dispute or chargeback process.
Before submitting a chargeback, the customer is encouraged to contact GOGOLI so the matter can be investigated and potentially resolved.
The customer must not knowingly submit:
A fraudulent chargeback;
A duplicate claim;
A materially false claim;
A claim stating that an authorised order was unauthorised;
A claim concealing receipt of the product;
A claim inconsistent with evidence knowingly held by the customer.
GOGOLI may provide relevant order, payment, delivery, acceptance, communication, and contractual records to the payment provider when responding to a dispute.
Nothing in this section prevents a genuine claim or removes a mandatory legal remedy.
60. PRODUCT SAFETY
GOGOLI is the manufacturer of the products it produces unless the relevant listing expressly states otherwise.
Products are designed, handmade, assembled, or finished in Türkiye.
Customers must review:
Intended use
Material information
Age limitations
Care instructions
Safety warnings
Product-specific restrictions
Unless expressly stated otherwise, GOGOLI products are not toys and are not intended or marketed for children.
Certain products may contain:
Small components;
Long straps;
Chains;
Buttons;
Fasteners;
Metal parts;
Decorative components.
Product-specific safety information must be followed.
A customer who reasonably believes that a product may present a safety risk should stop using it and contact:
61. EU GPSR INFORMATION
For products offered to consumers in the European Union, GOGOLI will provide or make readily accessible, where required:
Manufacturer identity;
Manufacturer postal address;
Manufacturer electronic address;
EU responsible person identity;
EU responsible person postal address;
EU responsible person electronic address;
Product identifier;
Product image or type;
Applicable warnings;
Applicable safety instructions.
Current manufacturer, EU responsible-person, product-identification, warning, and safety information is available on the GOGOLI GPSR Product Safety Information page and, where applicable, the relevant product offer.
The EU authorised representative is not the seller, distributor, payment recipient, tax representative, commercial sales agent, or returns centre unless separately agreed in writing.
The signed mandate is retained by the parties and is not published as a customer-facing contract.
62. CUSTOMER MISUSE
GOGOLI is not responsible, to the extent permitted by law, for damage caused by:
Use contrary to instructions;
Use for an undisclosed purpose;
Excessive loading;
Improper washing;
Improper drying;
Improper storage;
Bleach;
Harsh chemicals;
Unauthorised repair;
Cutting;
Alteration;
Excessive stretching;
Contact with sharp objects;
Accidental damage;
Normal wear;
Failure to act on a safety warning.
This section does not exclude liability where GOGOLI is legally responsible for an unsafe, defective, or non-conforming product.
63. INTELLECTUAL PROPERTY
Purchasing a physical product does not transfer intellectual-property rights in:
The product design;
Pattern;
Chart;
Written instructions;
Photographs;
Videos;
Product descriptions;
Branding;
Logo;
Packaging;
Graphics;
Collection names;
Website content.
Except where legally permitted, the customer must not commercially reproduce, copy, publish, distribute, or exploit GOGOLI’s protected original material without written permission.
GOGOLI does not claim exclusive rights in:
Traditional craft techniques;
Common stitches;
Public-domain motifs;
General ideas;
Elements that cannot legally be protected.
64. PERSONAL DATA
Personal information may be processed for purposes including:
Order administration
Payment
Fraud prevention
Production
Personalisation
Delivery
Customs
Customer support
Returns
Refunds
Complaints
Product safety
Legal compliance
Dispute management

Acceptance of this Agreement does not constitute consent to optional promotional marketing.
65. ELECTRONIC COMMUNICATIONS
The customer agrees that contractual communications may be sent electronically to the email address supplied at checkout.
Electronic communications may include:
Order receipt
Order acceptance
Payment information
Production updates
Shipping confirmation
Contractual documents
PDF confirmation
Withdrawal acknowledgement
Refund confirmation
Safety notice
Recall notice
The customer is responsible for supplying a valid email address and checking:
Inbox
Spam folder
Junk folder
Promotions folder
A failure to read an email does not invalidate a properly sent communication where mandatory law permits this conclusion.
66. DURABLE-MEDIUM CONFIRMATION
After the order is placed, GOGOLI will provide the customer with the legally required contractual information in a durable medium.
The confirmation will ordinarily be sent to the email address provided by the customer at checkout. The required information may be contained in the email itself, attached to the email, or provided through another legally valid format that allows the customer to retain and reproduce the information without alteration for an appropriate period.
The confirmation will ordinarily include or identify:
The order-specific information
The applicable Distance Sales Agreement version
The applicable Pre-Contract Information version
The principal product information
The customer’s selected options
The final price and applicable charges
Payment information
Production or processing information
Delivery information
Withdrawal information
Relevant policy and contractual-document references
Where the configured GOGOLI system successfully generates an order-specific PDF, that PDF may also be attached to the confirmation email or otherwise made available to the customer in a retainable format.
An order-specific PDF is an additional method of providing the contractual information and is not the only form of durable-medium confirmation used by GOGOLI.
If an automated PDF is not generated, cannot be attached, or is affected by a technical interruption, GOGOLI will provide the required contractual information by email or another legally valid durable medium within the applicable period.
The customer may request another copy of the available contractual confirmation by contacting GOGOLI and providing sufficient information to identify the order.
67. RECORDS AND EVIDENCE
GOGOLI may retain, subject to applicable privacy law:

Product records
Agreement versions
Pre-Contract Information versions
Acceptance date and time
Customer checkbox records
Checkout totals
Payment status
Customer communications
Bespoke approvals
Production records
Delivery records
Tracking records
Return records
Refund records
Complaint records
Chargeback records
Product-safety records
These records may be used to:
Perform the contract;
Demonstrate compliance;
Resolve disputes;
Respond to payment claims;

68. FORCE MAJEURE AND EVENTS OUTSIDE REASONABLE CONTROL
GOGOLI is not liable for delay caused solely by an event outside reasonable control to the extent permitted by law.
Such events may include:
Natural disaster
Fire
Flood
Earthquake
War
Civil disturbance
Government restriction
Sanctions
Epidemic
Pandemic
Severe transport interruption
Postal shutdown
Customs shutdown
Major platform outage
Major payment-system outage
Power interruption
Internet interruption
Serious illness or emergency directly affecting the sole maker
GOGOLI will take reasonable steps to reduce the effect of the event.
Where performance is materially delayed or becomes impossible, GOGOLI will provide the information, cancellation option, refund, or other remedy required by mandatory law.
Ordinary stock shortage is not automatically treated as legal impossibility.
69. LIMITATION OF LIABILITY
Nothing in this Agreement excludes or limits liability that cannot legally be excluded or limited, including liability for:
Fraud;
Fraudulent misrepresentation;
Death or personal injury caused by legally attributable negligence;
Unsafe products where liability is mandatory;
Intentional misconduct;
Gross negligence where exclusion is prohibited;
Mandatory consumer rights.
Subject to those protections, GOGOLI is not liable for loss caused solely by:
Incorrect customer-supplied information;
Customer misuse;
Failure to follow instructions;
Unauthorised alteration;
Failure to complete customs procedures;
Independent bank charges;
Independent currency fluctuations;
Events outside reasonable control.
Where the customer purchases a product primarily for personal use, GOGOLI is not responsible for commercial, business, resale, or profit losses that were not disclosed and agreed as part of the contract, to the extent permitted by law.
Any liability limitation will be interpreted narrowly and will not reduce a mandatory remedy.

GOGOLI will review complaints fairly and within the period required by applicable law.
Contacting GOGOLI first does not remove or suspend a mandatory legal deadline or authority procedure.
71. DISPUTE RESOLUTION — TÜRKİYE
Consumers in Türkiye may apply, according to the applicable subject-matter and monetary limits, to:
The competent Consumer Arbitration Committee; or
The competent Consumer Court after completing any mandatory pre-litigation mediation requirement.
The competent authority and applicable monetary limits are determined under the law in force when the application is made.
Nothing in this Agreement requires a consumer to waive a legally competent forum.
72. INTERNATIONAL CONSUMER REMEDIES
A consumer outside Türkiye retains any mandatory right to contact:
A competent court;
A consumer authority;
A data-protection authority;
A product-safety authority;
A legally available alternative dispute-resolution body;
Another competent public body.
GOGOLI is not committed to a voluntary dispute-resolution scheme unless expressly stated or legally required.
73. GOVERNING LAW
This Agreement is governed by the laws of Türkiye.
This choice does not deprive a consumer of mandatory protections available under the law that would apply in the absence of the choice of law.
Mandatory rules concerning:
Consumer protection;
Product safety;
Privacy;
Jurisdiction;
Statutory guarantees;
Withdrawal;
Dispute resolution
remain applicable where legally required.
74. CONTRACT LANGUAGE
The primary contractual language of the Store is English unless another official contractual version is expressly provided.
Translations may be supplied for convenience.
A translation will not be interpreted to remove or reduce a mandatory consumer right.
Where an official translated version is supplied, the versions will be interpreted consistently with:
The information presented before payment;
The purpose of the contract;
Mandatory law.
75. ASSIGNMENT
The customer may not transfer contractual obligations to another person without GOGOLI’s written agreement, except where mandatory law allows the transfer.
GOGOLI may use service providers to perform parts of the contract, including payment, shipping, technology, customs, or communication services.
Use of a service provider does not remove GOGOLI’s responsibilities under mandatory law.
GOGOLI will not transfer the contract in a manner that reduces the customer’s mandatory rights.
76. NO WAIVER
A delay or failure by either party to exercise a contractual right does not automatically waive that right.
A waiver is effective only to the extent clearly stated.
No waiver can remove a mandatory consumer right.
77. SEVERABILITY
Where a provision of this Agreement is found invalid, unlawful, or unenforceable:
That provision will be interpreted or limited to the minimum extent necessary;
The remaining provisions will continue to apply;
Mandatory law will replace the invalid provision to the extent required.
78. PRIORITY OF TERMS
Where contractual documents conflict, the following order of priority applies, subject to mandatory law:
Individually approved bespoke specifications;
The final order-specific confirmation;
The final checkout summary;
The relevant product-specific information;
This Distance Sales Agreement;
The Pre-Contract Information;
The Terms of Service;
The Returns, Refunds & Cancellations Policy;
The Shipping Policy;
Other general Store information.
A more specific provision applies over a general provision to the extent of the conflict.
Mandatory law always prevails.
79. CHANGES TO THIS AGREEMENT
GOGOLI may update the master Agreement for future orders to reflect:
Legal changes;
Operational changes;
Product-safety requirements;
Service-provider changes;
Business-information changes;
Clarification of existing provisions.
Each version will have a revision date and version identifier.
The version applicable to an order is the version presented before that order was submitted and recorded in the order-specific confirmation.
A later website version does not retrospectively change an existing contract unless legally permitted and properly communicated.
80. ENTIRE CONTRACT
The contractual record consists of the documents identified in this Agreement.
A customer should not rely on an oral statement that is inconsistent with the written product information or order confirmation unless GOGOLI expressly confirms that statement in writing.
This section does not exclude liability for fraud, fraudulent misrepresentation, or another liability that cannot legally be excluded.
81. DURATION
This Agreement applies to a one-time purchase unless the order expressly states otherwise.
The Agreement continues until the parties’ applicable obligations are completed, including:
Payment;
Production;
Delivery;
Valid withdrawal;
Return;
Refund;
Statutory guarantee;
Complaint;
Product-safety action;
Unresolved legal claim.
Provisions that logically continue after completion remain effective, including provisions concerning:
Intellectual property;
Records;
Privacy;
Disputes;
Product safety;
Liability;
Applicable law.
82. CUSTOMER ACCEPTANCE
Before submitting an order, the customer is required to review:
The selected products;
Selected options;
Quantities;
Product descriptions;
Materials;
Measurements;
Production status;
Production estimate;
Delivery information;
Final amount payable;
Pre-Contract Information;
This Agreement;
Applicable policies.
By submitting an order through the required acceptance and payment mechanism, the customer confirms that:
The customer had the opportunity to review the applicable information;
The customer reviewed the final order summary;
The customer understands that the order creates an obligation to pay;
The customer confirms that supplied information is accurate;
The customer accepts the applicable contractual documents, subject to mandatory law.
