TERMS OF SERVICE
Welcome to GOGOLI.
These Terms of Service govern your access to and use of the GOGOLI online store, website, content, products, customer accounts, communications, and related services.
In these Terms, “GOGOLI,” “we,” “us,” and “our” mean Gönül Köseoğlu, trading as GOGOLI, as identified in the Legal Notice and Contact Information.
By accessing or using the store, you agree to the provisions of these Terms that govern website use, acceptable use, intellectual property, privacy, security, and related services.
By creating a customer account or placing an order, you agree to the order-related Terms and policies presented or made available to you before checkout. If you do not agree, you must not use the relevant service, create an account, or place an order.
Nothing in these Terms excludes or limits any consumer right that cannot legally be excluded or limited.
1. RELATED POLICIES AND CONTRACT DOCUMENTS
These Terms should be read together with:
The product page and product description
The price and delivery information shown at checkout
The Returns, Refunds & Cancellations Policy
The Shipping Policy
The Privacy & Data Protection Policy
The Cookie Policy and privacy preferences, where applicable
The Legal Notice and Contact Information
The Pre-Contract Information, where applicable
The Distance Sales Agreement, where applicable
The Transaction Guide
Any written custom-order specifications approved by you
The order confirmation and other information provided before or after purchase
Together, these documents form part of the agreement relating to your order, to the extent applicable.
Where a specific written agreement for a bespoke order conflicts with these general Terms, the specifically agreed written terms will apply to that order, subject to mandatory law.
2. ELIGIBILITY
You may use the store and place an order only if:
You are legally capable of entering into the transaction; or
You act with the permission and supervision of a parent or legal guardian where required by law; and
The information you provide is accurate, complete, and current
The store is not intended for unsupervised use by children.
You must not use the store for any unlawful, fraudulent, abusive, misleading, or unauthorised purpose.
3. CUSTOMER ACCOUNTS
Where customer accounts are available, you are responsible for:
Keeping your login details confidential
Restricting access to your device and account
Providing accurate account information
Informing us promptly of suspected unauthorised access
You are responsible for activity carried out through your account unless mandatory law provides otherwise or the activity occurred because of a security failure attributable to GOGOLI.
We may suspend access to an account where reasonably necessary to protect customers, investigate suspected fraud, comply with law, or secure the store.
4. PRODUCTS AND HANDMADE CHARACTER
GOGOLI products are handmade, hand-finished, produced in small quantities, or created using craft-based processes.
Because of this, reasonable variations may occur in:
Stitch tension
Motif placement
Dimensions
Yarn or material texture
Colour distribution
Surface character
Finishing details
Placement of naturally varying decorative elements
These small and reasonable differences are part of the handmade character of the product and do not, by themselves, constitute a defect.
This does not limit your rights where a product is materially different from its description, incorrectly made, damaged, unsafe, or legally defective.
5. PRODUCT IMAGES, COLOURS, AND DESCRIPTIONS
We make reasonable efforts to display products and describe their characteristics accurately.
However:
Screen settings and device displays may affect colour appearance
Photography and lighting may cause slight visual differences
Yarn, leather, fabric, paper yarn, dye, and other material batches may vary slightly
Handmade dimensions may include a reasonable tolerance
Props and decorative objects shown in photographs are not included unless expressly stated
The product description identifies what is included in the purchase.
If a material, measurement, colour, or characteristic is essential to your decision, contact us before placing the order.
Customers with a known allergy, sensitivity, or material restriction are responsible for reviewing the disclosed composition and contacting GOGOLI before ordering where further information is required. This does not limit any mandatory product-safety right or responsibility.
For product-safety details and safety-related contact information, please review our GPSR Product Safety Information page.
We are not responsible for assumptions that contradict information clearly stated in the product description, size guide, photographs, care instructions, or policies.
6. MEASUREMENTS, FIT, AND CUSTOMER RESPONSIBILITY
Measurements and size guidance are provided to help you make an informed purchasing decision.
The appearance, drape, length, and fit of a garment may vary from person to person depending on factors such as height, body shape, proportions, posture, and preferred fit.
Product photographs showing an item on a model are provided as a visual reference only. They do not guarantee that the item will appear, fall, or fit in exactly the same way on every customer.
Where model information is provided, including the model’s height, measurements, usual size, or the size worn in the photographs, this information is intended only to provide additional context and should not replace the garment measurements and size information stated on the product page.
Before purchasing, you are responsible for:
Reviewing the complete garment measurements and size information
Comparing the listed measurements with a similar item you already own, where appropriate
Considering your own body measurements, proportions, and preferred fit
Checking whether the product dimensions meet your intended use
Contacting us before ordering if any measurement, fit, or sizing information is unclear
Size labels alone do not guarantee an identical fit across different garments, body shapes, proportions, or brands.
A difference between how a garment appears on the model and how it appears on the customer is not, by itself, considered a defect, provided that the product supplied corresponds materially to its description, photographs, stated measurements, and size information.
This section does not limit your rights where the measurements or material information supplied by GOGOLI are materially inaccurate, or where the product is defective or materially different from its description.
7. CARE AND USE
You must follow the care, storage, washing, handling, and use instructions supplied with the product or stated on the product page.
Damage caused by:
Improper washing or drying
Use of unsuitable cleaning products
Excessive stretching or pulling
Cutting, alteration, repair, or modification
Improper storage
Exposure to unsuitable heat, moisture, chemicals, friction, or weight
Normal wear and ageing
is not considered a manufacturing defect unless mandatory law provides otherwise.
8. MADE-TO-ORDER AND BESPOKE PRODUCTS
Some products may be:
Ready to ship
Made to order in a standard design
Made according to personal measurements
Bespoke or clearly personalised
A product is not automatically non-returnable merely because it is handmade or made after an order is placed.
However, products made to a customer’s individual specifications or clearly personalised may be excluded from change-of-mind cancellation or return rights where permitted by law.
Before beginning a bespoke order, we may ask you to confirm in writing:
Measurements
Colours
Materials
Design details
Motif arrangement
Personalised wording
Production estimate
Price
Other individual specifications
You are responsible for reviewing these details carefully.
Once you approve the specifications and dedicated production or material preparation begins, changes or cancellation may no longer be possible where permitted by law.
If you request a change after approval, we may:
Refuse the change where it is technically or commercially impracticable
Revise the price
Revise the production time
Require payment of reasonable additional costs before continuing
We will not make a material change to an approved bespoke design without your agreement.
9. PRICES AND CURRENCY
Prices are displayed in the currency shown on the store or at checkout.
Unless stated otherwise, prices include or exclude taxes according to the customer’s location, applicable tax rules, and the checkout information presented before payment.
International customers may be responsible for:
Import duties
Import taxes
Customs processing charges
Brokerage fees
Currency-conversion charges imposed by banks or payment providers
These charges may be collected at checkout or separately by a payment provider, carrier, customs authority, or public body.
GOGOLI does not control exchange rates or independent charges imposed by banks, card issuers, payment providers, carriers, or customs authorities.
10. PRICING AND INFORMATION ERRORS
We may correct typographical, technical, calculation, currency, inventory, description, or pricing errors before accepting an order.
If an obvious or material error affects an order, we may contact you to:
Confirm the order at the corrected price or information; or
Cancel the affected item or order and issue the appropriate refund
We will not increase the agreed price of an accepted order without your consent, except where a change is required by law or results from a change you requested.
A price or offer that is clearly and objectively erroneous does not oblige us to supply a product at that incorrect price where the law permits correction.
11. PLACING AN ORDER AND CONTRACT FORMATION
Product listings and store displays are invitations to place an order and do not necessarily constitute an irrevocable offer by GOGOLI.
By submitting an order, you make an offer to purchase the selected products under the information and terms presented before payment and acknowledge that submitting the order creates an obligation to pay the amount shown at checkout.
An automated order acknowledgment confirms that we have received the order and that payment has been authorised or collected, where applicable. It does not necessarily mean that the order has been finally accepted unless the acknowledgment, checkout, or applicable law expressly provides otherwise.
A payment authorisation, payment capture, or automated order number does not by itself guarantee acceptance of the order unless the checkout or confirmation expressly states that acceptance has occurred.
An order is accepted when we:
Send an express order-acceptance or fulfilment confirmation;
Dispatch a ready-to-ship product; or
For an accepted made-to-order or bespoke product, confirm the required specifications and begin dedicated production or preparation
whichever occurs first.
Where the checkout or an order confirmation expressly states that the order has been accepted, acceptance occurs at the time stated in that communication.
Before acceptance, we may review product or material availability, payment status, fraud or security indicators, delivery restrictions, address information, and the feasibility of made-to-order or bespoke specifications.
Mandatory rules governing contract formation in the customer’s location remain unaffected.
12. OUR RIGHT TO DECLINE OR CANCEL AN ORDER
Before an order is accepted, we may decline or cancel it for a legitimate reason, including:
Product or material unavailability
An obvious pricing or listing error
Inability to complete a bespoke request
Delivery restrictions
Legal, sanctions, customs, or export restrictions
Suspected fraud, misuse, resale, or unauthorised activity
Inability to verify payment, identity, address, or order information
A technical error affecting the transaction
Conduct that threatens the safety, rights, or lawful interests of GOGOLI or another person
Where an order has been paid but is not accepted or is cancelled by us, the applicable payment will be refunded.
We will not cancel an accepted consumer order arbitrarily where doing so would violate mandatory law.
We may limit quantities or refuse orders that appear intended for unauthorised resale, copying, commercial sampling, or abuse of promotions.
13. PAYMENT
You must provide valid and authorised payment information.
Payments may be processed by Shopify, iyzico, banks, card networks, or other providers displayed at checkout.
We do not ordinarily receive or store your complete card number or security code.
Payment may be subject to:
Authorisation
Identity verification
3D Secure authentication
Fraud screening
Provider terms
Currency conversion
Regulatory controls
A payment authorisation does not by itself guarantee acceptance of the order.
14. FRAUD, CHARGEBACKS, AND PAYMENT DISPUTES
We may retain and submit relevant order, communication, delivery, tracking, product, and transaction evidence when responding to a payment dispute or chargeback.
Before opening a payment dispute, you are encouraged to contact us so that we can review and, where appropriate, resolve the issue.
Nothing in these Terms prevents a customer from exercising a legitimate statutory, card-network, or payment-provider right.
However, fraudulent claims, knowingly false statements, duplicate recovery attempts, or chargebacks initiated after retaining a properly delivered product may be challenged using available evidence and may result in restrictions on future orders where legally permitted.
15. PRODUCTION AND PROCESSING TIMES
Production and processing times shown on product pages are estimates unless expressly stated to be guaranteed.
An estimate may be affected by:
The complexity of handmade production
Material availability
Approval of bespoke details
Seasonal order volume
Illness or emergency
Carrier availability
Customs or public-authority procedures
Events outside our reasonable control
Where a material delay occurs, we will provide notice where reasonably possible and offer any remedy required by applicable law.
The customer’s delay in supplying measurements, approving specifications, responding to questions, or providing complete information may extend the production schedule.
16. SHIPPING AND DELIVERY
Shipping and delivery are governed by the Shipping Policy and the delivery information shown at checkout.
You are responsible for providing:
A complete and accurate delivery address
A reachable telephone number where required for delivery
Accurate recipient and customs information
Timely responses to carrier or customs communications
We may use a carrier or delivery service appropriate to the destination, product, parcel size, and selected service.
Delivery dates are estimates unless expressly guaranteed.
For consumer orders, risk of loss or damage remains with GOGOLI until the product is delivered to the consumer or a person designated by the consumer, except where mandatory law provides otherwise.
After delivery, the customer is responsible for reasonable safekeeping of the product.
17. INTERNATIONAL ORDERS AND CUSTOMS
International orders may be inspected or delayed by customs authorities.
Customers must not ask GOGOLI to:
Undervalue a parcel
Describe a commercial order as a gift
Use a false product description
Provide inaccurate customs information
Circumvent tax, customs, sanctions, or import rules
We will complete customs documentation truthfully.
The customer is responsible for checking whether the product may lawfully be imported, possessed, or used in the destination country.
Where duties or import charges are not collected at checkout, the customer may be required to pay them before delivery.
Refusing or failing to collect a parcel solely to avoid customs charges does not automatically cancel the order or create an unconditional right to a full refund.
18. RETURNS, REFUNDS, CANCELLATIONS, AND EXCHANGES
Returns, refunds, cancellations, and exchanges are governed by the Returns, Refunds & Cancellations Policy.
That policy forms part of these Terms.
Nothing in these Terms or that policy limits rights relating to damaged, defective, unsafe, incorrect, or materially misdescribed products where those rights cannot legally be excluded.
19. PROMOTIONS, DISCOUNTS, AND GIFT CARDS
Promotional offers may be subject to:
A stated validity period
Eligible products or customers
Quantity restrictions
Geographic limitations
A minimum purchase amount
Exclusion from combination with other offers
Unless otherwise stated, discounts cannot be applied retrospectively to completed purchases.
We may withdraw or correct a promotion before an order is accepted if it was published in error or is being abused.
Gift cards, if offered, are subject to the terms stated at purchase and mandatory law. Gift cards may not be redeemable for cash except where required by law.
20. ACCEPTABLE USE OF THE STORE
You must not:
Use the store for unlawful or fraudulent purposes
Attempt unauthorised access to the store, accounts, systems, or data
Introduce malware, malicious code, or harmful technology
Scrape, crawl, harvest, extract, or systematically copy store content without permission
Interfere with checkout, security, pricing, inventory, or store operation
Impersonate another person
Submit false reviews, claims, identity information, or payment information
Use automated purchasing tools in a way that harms customers or store operation
Use the store to infringe intellectual-property, privacy, or other rights
Harass, threaten, deceive, or abuse GOGOLI or another person
We may take proportionate measures to investigate and stop misuse.
21. INTELLECTUAL PROPERTY
Unless otherwise stated, the GOGOLI website and its original content are protected by applicable intellectual-property laws.
Protected material may include:
The GOGOLI name and logos
Product photography
Videos
Written descriptions and editorial text
Packaging and card artwork
Original graphics and layouts
Original product designs and distinctive arrangements
Original patterns, charts, instructions, and illustrations
Collection names and presentation concepts
Website content and brand materials
Purchasing a physical product does not transfer copyright, trademark rights, design rights, or other intellectual-property rights.
Without prior written permission, you may not:
Reproduce, distribute, sell, license, or commercially exploit protected content
Copy photographs or product descriptions for another store
Remove watermarks, attribution, labels, or rights notices
Create commercial replicas from protected original designs
Extract or reproduce a pattern from a purchased product for commercial distribution
Use GOGOLI content to market another seller’s products
Use website content, photographs, or original designs to train or develop commercial artificial-intelligence or machine-learning systems
Suggest that GOGOLI endorses or is affiliated with another business
Personal sharing of a lawful link to a public GOGOLI page is permitted, provided it is not misleading.
GOGOLI does not claim exclusive ownership of traditional craft techniques, public-domain motifs, general ideas, or other subject matter that cannot legally be protected. Our rights relate to protectable original expression, branding, content, and design elements.
22. CUSTOMER CONTENT, REVIEWS, AND SUBMISSIONS
If you submit a review, photograph, comment, suggestion, or other content, you confirm that:
You have the right to submit it
It is not knowingly false, defamatory, unlawful, or misleading
It does not infringe another person’s rights
It does not contain unnecessary sensitive personal information
You retain ownership of your original content.
Where you voluntarily submit content for publication, you grant GOGOLI a non-exclusive, worldwide, royalty-free licence to display, reproduce, format, translate, and use it for operating and promoting the store, unless otherwise agreed.
We will not use private customer-service photographs or personal information for public marketing without an appropriate legal basis or permission.
We may remove public content that is unlawful, abusive, irrelevant, deceptive, infringing, or contains personal or confidential information.
23. THIRD-PARTY SERVICES AND LINKS
The store may use or link to third-party services, including:
Shopify
Payment providers
Delivery providers
Social-media platforms
Analytics or communication services
External websites
Third parties may have their own terms and privacy policies.
GOGOLI is not responsible for independent third-party content, policies, availability, security, or actions beyond our reasonable control.
This clause does not remove any responsibility that mandatory law places on GOGOLI for providers used to perform our contract with you.
24. STORE AVAILABILITY AND CHANGES
We may update, improve, restrict, suspend, or discontinue parts of the store for:
Maintenance
Security
Legal compliance
Technical changes
Service-provider changes
Business or operational reasons
We do not guarantee that the website will always be uninterrupted or error-free.
We will not use this clause to avoid fulfilling an accepted order or a mandatory legal obligation.
25. WARRANTIES AND STATUTORY RIGHTS
Products will be supplied in accordance with their description and any mandatory standards that apply.
No statement in these Terms excludes statutory guarantees or remedies that cannot legally be excluded.
To the extent permitted by law, we do not provide additional guarantees beyond:
The product description
A specific written guarantee expressly supplied with the product
Mandatory rights under applicable law
General statements about quality, craftsmanship, durability, or expected use must be read together with the product description, materials, care requirements, and normal wear.
26. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited, including liability for:
Fraud or fraudulent misrepresentation
Intentional misconduct or gross negligence where it cannot be excluded
Death or personal injury caused by negligence where applicable
Mandatory product-safety or product-liability obligations
Any consumer right or remedy that cannot legally be limited
For consumers, GOGOLI is responsible for direct and reasonably foreseeable loss caused by our breach, subject to applicable law.
We are not responsible for loss caused by:
Incorrect information supplied by the customer
Customer misuse or failure to follow care instructions
Independent bank or currency-conversion charges
Unlawful import restrictions unknown to us
Events outside our reasonable control
Third-party acts for which mandatory law does not make us responsible
We are not responsible for purely commercial loss, loss of profit, loss of business opportunity, or loss of goodwill suffered by a person purchasing primarily for business purposes, to the extent permitted by law.
For a business customer, and only to the extent permitted by law, GOGOLI’s total contractual liability concerning an affected order will not exceed the amount paid for that order, except for liabilities that cannot legally be limited.
27. CUSTOMER RESPONSIBILITY FOR UNLAWFUL MISUSE
You remain responsible under applicable law for losses reasonably caused by your:
Fraudulent use of the store
Deliberate security interference
Unlawful use of another person’s payment information
Infringement of intellectual-property rights
Submission of unlawful content
Material breach committed in bad faith
This clause does not impose liability beyond what applicable law permits and does not apply merely because a consumer exercises a legitimate legal right.
28. EVENTS OUTSIDE REASONABLE CONTROL
We are not responsible for delay or failure caused by an event outside our reasonable control, including:
Natural disasters
Fire or flood
War, terrorism, civil unrest, or sanctions
Epidemics or public-health restrictions
Government or customs action
Postal or carrier disruption
Power, internet, platform, or payment-network failure
Material shortages
Labour disputes
Serious illness or emergency affecting handmade production
We will take reasonable steps to reduce the effect of the event and communicate material delays where reasonably possible.
If performance becomes impossible or is delayed beyond a period permitted by mandatory law, the customer retains any applicable cancellation or refund rights.
29. SUSPENSION AND TERMINATION
We may suspend or terminate access to the store or an account where reasonably necessary because of:
Fraud or security risk
Serious or repeated misuse
Unlawful activity
Material breach of these Terms
A legal or regulatory requirement
Termination does not remove rights or obligations that arose before termination.
Provisions concerning payment, intellectual property, disputes, liability, and records may continue where their nature requires.
30. GOVERNING LAW AND DISPUTES
Please contact us first so that we have a reasonable opportunity to review and resolve a concern.
These Terms and orders placed with GOGOLI are governed by the laws of Türkiye, without depriving a consumer of mandatory protections available under the law that applies to that consumer.
Consumers in Türkiye may use the competent Consumer Arbitration Committee, Consumer Court, or other authorised dispute-resolution mechanism in accordance with applicable procedural and monetary rules.
Consumers outside Türkiye retain any right to bring proceedings before a competent court or authority that cannot legally be excluded by these Terms.
For disputes involving a customer acting primarily for business purposes, and only where legally valid, the courts and enforcement offices of İstanbul, Türkiye will have jurisdiction.
Nothing in this section prevents either party from seeking urgent protective relief or using a mandatory public dispute-resolution procedure.
31. CHANGES TO THESE TERMS
We may update these Terms for legal, regulatory, security, technical, operational, or business reasons.
Updated Terms will be published with a new revision date.
Changes will not retroactively alter an accepted order unless:
The change is required by law;
The change benefits the customer; or
Both parties agree
The Terms presented or made available in connection with an order will generally apply to that order.
32. SEVERABILITY
If part of these Terms is found invalid, unlawful, or unenforceable, that part will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply where legally possible.
33. NO WAIVER
If we do not immediately enforce a provision, this does not mean that we waive the right to enforce it later.
A waiver is effective only for the particular situation to which it relates.
34. ENTIRE AGREEMENT
These Terms and the documents incorporated into them represent the agreement concerning use of the store and relevant purchases, except for:
Mandatory legal rights
A specific written bespoke-order agreement
Information that must legally form part of the contract
A later written agreement signed or expressly accepted by the parties
